About the opportunity
Enforcement Legal is responsible for monitoring and enforcing compliance with Victoria's accident compensation and health and safety laws. Enforcement Legal has a team of criminal, administrative, OH&S and compensation legal specialists.
This position is accountable for providing specialist legal advice to support both accident compensation and OH&S prosecutions and providing advice on the conduct of investigations.
Key accountabilities
- Provide strategic and timely expert oral and written advice to WorkSafe via the Lead Lawyer on complex legal and policy issues.
- Build and maintain effective working relationships with key internal and external stakeholders. The incumbent must manage constructive relationships in a sensitive and potentially volatile environment.
- Supervise the work performed by paralegals in relation to matters under the lawyer's control.
- Provide legal advice to WorkSafe on aspects of Enforcement Legal's work, including litigation, interpretation of legislation, legal policy and risk management.
- Assist with the conduct of prosecutions on behalf of WorkSafe including, in appropriate cases, appearing as advocate. Travel to regional Courts will be required.
- Provide legal support and advice to individual investigators and investigation teams.
- Follow and assist in the development and implementation of guidelines, policies and strategies for effective delivery of legal services to the Division.
- Liaise with external agencies including the Office of Public Prosecutions, Victoria Police and WorkSafe's external legal providers in relation to compliance and enforcement activity.
About you
You are an experienced Lawyer, with specialist knowledge of criminal law, court practice and procedure and the law of evidence in respect of both summary and indictable prosecutions. Your written and verbal communications skills are highly developed, and your exemplary organisational skills allow you to meet tight deadlines and effectively manage varying and complex workloads.
Additionally, you possess the following skills and experience:
- Demonstrated specialist knowledge of criminal law, court practice and procedure and the law of evidence in respect of both summary and indictable prosecutions.
- Demonstrated advanced technical experience, knowledge and skills to advance investigations and/or prosecutions.
- Demonstrated ability to identify potential issues in investigations and the generation of solutions.
- Demonstrated experience in the conduct of enforcement litigation and providing legal advice in a compliance and enforcement context.
- Demonstrated experience in conducting litigation with limited supervision.
- Demonstrated advocacy experience, particular in courts of summary jurisdiction.
- Must hold a current Victorian driver licence and have the ability to travel to court appearances as required.

- You will have tertiary qualifications
- Admitted to practice as an Australian Lawyer with at least 3 years post admission experience.
